Boy To Remain In Foster Care After Brother's Disappearance
Parents Go To Court To Regain Custody Of Son

IRVING, Texas -- A judge said the parents of a missing 2-year-old who disappeared from Lively Park in Irving will not regain custody of their 4-year-old child, Alexis.
Yancy Majano admits she was in the park, not with the children's father, but with another man, at the time of Elian Majano's disappearance. Majano has said the man was only a friend and was giving her a tour of the park.
Majano insists she only lost sight of the boys for 30 seconds but her signed statement after the incident differs from what she said in court on Wednesday.
"I think it was unfair to put her on trial. You could have achieved the same thing just by talking to police officers. This is a woman who's been put through enough," said Raul Loya, an attorney for the boy's parents.
Majano and her husband appeared in court to explain why they should regain custody of Alexis. The couple said they have done nothing wrong and should not be blamed for what appears to be the tragic abduction of their child. However, authorities said there is a pattern of deception and neglect by the mother.
"The idea that there was only 30 seconds and something happened to them just really didn't make sense to us," said Marissa Gonzales with Child Protective Services. "The fact that they were alone, unattended, was really the concern for us."
Alexis will remain in foster care as police continue searching for the 2-year-old.
