Michael Anthony Rodriguez Jr., 19, and Joseph Anthony Olivio, 20, are charged with sexual assault of a child.
On July 13, Austin Police Department detectives received information regarding a 14-year-old victim who had sex with two suspects, who are brothers.
Police made contact with the victim's mother to schedule an interview with the girl for July 16. On July 16, the victim told detectives her report of the incident. Below is her statement:
She was a runaway with her 14-year-old brother. His cousin, Olivio, met them in a taxi outside of her home in the middle of the night on June 28. The trio then went to a South Austin apartment complex to swim before returning to Olivio's house around 8 a.m. The 14-year-old girl said that she fell asleep and was awakened by her boyfriend to have sex.
The victim said that after the act, her boyfriend told her that she had to have sex with his cousin, Rodriguez, so that he would give them a ride. The girl said she did not want to have sex with Rodriguez, but her boyfriend told her she had to.
The victim said Rodriguez did not wear a condom when she had sex with him. She told detectives that after having sex with Rodriguez, he asked her how old she is and if she is a "youngster."
At this point Rodriguez left the room and the victim's boyfriend returned to tell her that she now had to have sex with his other cousin Olivio because he is mad he did not "get any."
The victim re-attempted to tell him that she did not want to do that which angered him. The 14-year-old boyfriend told the girl she had to or else Rodriguez would not give them a ride.
Rodriguez entered the room, and the victim reiterated that she did not want to have sex with him. Olivio responded by undressing and saying, "What's wrong, you don't like seeing this?"
Olivio started the have sex with her anyway. Rodriguez then gave the victim and her boyfriend a ride.
